Trayvon Martin Act

Introduction ~ It’s time to take action to stop racial profiling and police containment in Black and Brown communities here in Connecticut.  Every 28 hours a Black person is killed somewhere by police, security guards and self-appointed vigilantes like George Zimmerman and Michael Dunn, according to a Malcolm X Grassroots Movement report . http://www.operationghettostorm.org/ . The veracity of the MXGM report has been disputed. See the Resources section below for a Washington Post editorial on the report, including a rebuttal by the report’s author. Trayvon was shot and killed after being confronted on the street by Zimmerman, an armed neighborhood watch leader. Dunn shot Jordan Davis during an argument about loud music.  Former Bay Area Rapid Transit police officer Johannes Mehserle murdered Oscar Grant in 2009.  http://sfbayview.com/2009/oscar-grant-young-father-and-peacemaker-executed-by-bart-police. Police in the United States kill at a rate of 70 times more than police in all other ‘first world’ nations.http://thefreethoughtproject.com/police-kill-citizens-70-times-rate-first-world-nations/   CP’s Trayvon Martin Act is aimed at addressing this public safety crisis.

The Trayvon Martin Act calls for the creation of a legislative task force on police misconduct and includes some of CP’s original racial profiling bill language. The CT legislature passed some of our provisions in 2012 and they were scheduled to go in effect July 1, 2013. Our traffic stop receipt language was repealed in favor of a version emphasizing electronic data collection and analysis, instead of a copy of the mandated “Traffic Stop Report” going to the motorist.  We believe this copy is the only way for motorists to know how their race is being represented and is a proven factor in undetected biased policing.  We sat in on testimony of dozens of motorists of color from around the state who were stopped, harassed, given tickets with race recorded as White, and heard of many other biased law enforcement actions.

Problem: Drivers do not get a copy of the Stop Report which has allowed some officers to lie about the race of the people they stop.  Some victims of profiling may not complain because they don’t know officers are covering up the profiled stops. As we mentioned previously our traffic stop language was passed by lawmakers in 2012 but was repealed due to pressure by the police before it was scheduled to become law in 2013.

Add to current law:  1) “Traffic Stop Reports are to be filled out in duplicate so that each motorist receives a copy of the completed form from the officer, in addition to any ticket or summons if one is issued.  2) The copy of the report should be given to the driver as well as the information on filing complaints if motorists believe they have been profiled.  3) If the reports are entered into an electronic data collection system a copy will be immediately available to the detained driver.”  https://hendu39.wordpress.com/2016/11/17/community-party-trayvon-martin-act-bill-language-4/

Policy Watch: Liberals Prefer Democratic Party Oppression

President Barack Obama delivered his farewell address last week from his hometown of Chicago. How appropriate. The Obama Justice Department did nothing to rein in the Chicago Police, the department that collaborated with the FBI to assassinate Black Panther Party Illinois Chairman Fred Hampton in 1969. The CPD remains one of the most brutal and corrupt departments in the country, as the Laquan MacDonald case showed. It took the furor over the video of the lynching of McDonald and the subsequent cover-up, to force the DOJ to launch an investigation. Obama refused a 2009 demand from members of the Congressional Black Caucus, that he implement targeted job creation in Black communities with the highest poverty and unemployment rates. The lack of jobs and resources fuels urban gun violence in Chicago, the murder capital of the nation.

 

Liberals who are clucking about last week’s DOJ announcements regarding the Baltimore and Chicago police, are in denial about what the DOJ investigations really mean. These departments will have to sign a consent decree, an agreement with the federal government that basically says, “We Promise to be Nice to Negroes.” The cops who have been murdering and brutalizing Black people, and the department brass who covered up for them will still be there.

 

During the Obama presidency there were high profile police murder cases in Ferguson, Baltimore, Cleveland and Chicago. DOJ investigations found that all of these departments engage in racist policing, and excessive use of force. The DOJ didn’t prosecute the officers who were involved in the incidents that brought worldwide attention to these racist departments. What’s wrong with this picture? Liberals are railing against Attorney General nominee Jeff Sessions, but are silent about Loretta Lynch and Eric Holder, who prosecuted ZERO cops for killing Black, Latino and Indigenous people. U.S. police kill at a rate of 70 times more than police in all other ‘first world’ nations.

 

Obama signed the National Defense Authorization Act, which allows the government to jail anyone without charges, or evidence. Obama bombed seven predominantly Muslim countries, and deported more undocumented immigrants than any other president. His administration will go down as being the most vicious against whistleblowers; the decision to commute the sentence of Chelsea Manning being the exception.

 

 

Donald Trump is the personification of the corporate state. Last week during a press conference Trump announced that his sons, Lucifer and Damien, will assume control of his business interests, in effect making the presidency a subsidiary of Trump’s company. Joel Simon, executive director of the Committee to Protect Journalists, talked to Democracy Now! host Amy Goodman about how Obama’s surveillance state model will likely be enhanced by Trump, following unsubstantiated reports that Russian intelligence has compromising information on the President-elect. The Trump press conference included a shouting match between the new President and CNN White House reporter Jim Acosta. Trump refused to take questions from Acosta after CNN reported on the story.

JOEL SIMON: Well, I think that my response is just we see on display the attitude that Trump exhibited throughout his campaign and in every interaction with the media, which is that he has a framework in which the media, as long as it amplifies his message, he welcomes it, but as soon as it adopts a critical posture, there’s a completely different response. And what’s really concerning here is, OK, he’s angry. You can understand why he’s angry. I mean, these reports were very damaging. But now that he’s going to become president, how will these attitudes be transformed into policies?

AMY GOODMAN: Well, you have his press secretary, for example, Sean Spicer, threatening Acosta, saying he’s going to throw him out if he tries to ask another question.

JOEL SIMON: Yeah, I mean, that’s very alarming. But I think what’s the broader context here is this involves a leak. OK? This information was leaked. Now, as president, with Jeff Sessions as attorney general, are we going to see leak investigations? I think we are. His framework is that these leaks from intelligence officials—apparently, that’s where they come from, we don’t know, but it’s certainly possible—create an atmosphere similar to Nazi Germany. OK? So we can expect aggressive leak investigations that—

AMY GOODMAN: So, just to be clear—

JOEL SIMON: Yeah.

AMY GOODMAN: it was Trump who said—who compared intelligence officials—

JOEL SIMON: Yeah, exactly.

AMY GOODMAN: —to Nazis.

JOEL SIMON: Exactly. So, that framework suggests there will be aggressive leak investigations. The Obama administration has created a legal framework through its aggressive prosecution of leakers, where journalists are very vulnerable. And I think it’s highly likely that if these attitudes, this anger, this lashing out at the media every time he’s criticized—if those are transformed into policies, my greatest concern is about aggressive leak investigations, which ensnare journalists and which represent a significant threat to journalists in this country and potentially globally.

 

January 20 is not the beginning of fascism, but merely a continuation. The President of the United States is an agent of Wall Street and the military industrial complex; a caretaker of fascism. It’s in the job description.
